The terms and conditions mentioned in this Legal Notice regulate the use of IGNIS ENERGÍA, S.L. Web (hereinafter, “IGNIS”) available for users (hereinafter, the “User” or “Users”).

The use of the Web by Users involves the acceptance of all conditions included in this Legal Notice.

The access and/or use of such services and contents express the entire and unconditional acceptance of particular conditions of the version published by IGNIS at the time of such access and/or use.

It is possible that throughout the provision of the services included in the Web, the name of the domain providing such services is changed. Therefore, Users acknowledge and accept this possibility, all obligations accepted by Users and IGNIS being fully in force according to the provisions of this document.

2.- Conditions of use of the contents and services

Users may only access the services and contents using the means and procedures made available for this purposes in the Web or normally used in Internet insofar as they do not imply a breach of intellectual or industrial property rights or entail any damage for the Web and/or its information or services offered.

The User undertakes to use the contents and services in a diligent, legal, correct and lawful manner and in particular undertakes as way of example and without limitation to refrain from:

Using the contents and services in a way and with purposes against the law, moral and generally accepted principles of morality and public order;
Breaching intellectual or industrial property rights of IGNIS or third parties;
Using the services and contents representing any damage or overload for Web operation;
Making fraudulent transactions or which favour illicit or fraudulent actions of any kind; and
Using contents and services and, in particular, the information of any kind obtained through the Web with marketing purposes and specially, to sending advertisements, communications with direct sale purposes or with any other commercial purpose, individual undesired messages, spam as well as selling or disseminating in any manner such information without the authorization of the owner and/or IGNIS.

Users shall be liable for the damages of any nature suffered by IGNIS either directly or indirectly as a consequence of the breach of any of the obligations arising from this Legal Notice or from the Law regarding the use of the Web.

3.- Third party links (outbound links)

The Web may include links allowing Users access to third parties’ Webs (“Third party Webs”) which shall not assume the existence of agreements with those responsible or owners of those webs. In these cases, IGNIS shall not be liable for the content of such webs. Any use of a link or access to a third party web shall fall under the sole risk and responsibility of the User.

Should the User consider that there is a Third party Web with illicit or inappropriate content, it may inform IGNIS to the content address provided in the first section of this Legal Notice, specifying:

Of the informant: name, address, telephone number and email address;
A description of the acts that prove the illicit or inappropriate nature of the Site Linked; and
An express statement that the information contained in the communication is accurate.

4.- Links to Web (inbound links)

Users who wish to include links in the Web from their own Webs may do so insofar as the Web Page establishing the link complies with the law and never connects to contents that:

Are illicit, harmful or against the moral and good uses (pornographic, violent, racist, etc.);
Give or may give the user the wrong impression that IGNIS subscribes, supports, adheres or in any manner shares the ideas, statements or expressions, either licit or illicit of the third party;
Are inappropriate or unsuitable for IGNIS activity according to the place, content and topic of the Web Page of the third party.

IGNIS may request at any time and without explaining the reasons for such request the elimination of any link to the Web after which the responsible of the linking Web shall immediately proceed to its elimination.

5- Intellectual and Industrial Property

All Web contents, understanding as such as way of example, the texts, photographs, graphs, images, icons, technology, software, links, domains, brands and other contents including audiovisual or sound, as well as their graphic designs and source codes are the exclusive property of IGNIS or third parties which rights are acknowledged by IGNIS and are subject to intellectual or industrial property rights protected by national and international legislation.

It is strictly forbidden to use any of the elements object of industrial or intellectual property with any purpose, specially commercial, as well as its distribution, public communication, modification, alteration, transformation or decompiling, unless with the express written authorization of IGNIS or the owner.

6.- Exclusion of guarantees and responsibility

IGNIS shall not be liable for:

(i) In the event of service interruptions, delays, mistakes, malfunction and in general, other inconvenients which may have their origin in causes beyond IGNIS control and/or due to a wilful or malicious action of Users and/or which have a Force Majeur origin. Without prejudice of the provisions of article 1105 of the Civil Code, they shall be understood as included in the Force Majeur clause and, for the purpose of these general conditions, all those events arising beyond IGNIS control such as: failure of third parties, operators and service companies, acts of Government, lack of access to third party networks, acts or omissions of Public Authorities, all others arising as a consequence of natural phenomena, blackouts, strikes, public order disturbances, hackers attacks, crackers and other third parties to the security or integrity of the IT system or any other arising from an event caused by a foreseeable progress of technology. In any case, regardless of the cause, IGNIS shall not assume any liability either for direct or indirect damages, emerging damages and/or lost profits.

(ii) the use by the Users of Web contents as well as of any other material contained in the Web, which may represent a breach of any rule, national or international, of the rights of intellectual or industrial property or any other right of third parties;

(iii) of potential security mistakes which may arise from the fact of using not updated browser versions or of the consequences that can arise from the wrong operation of the browser either due to inappropriate configuration, presence of virus or any other cause alien to the [ENTITY].

7.- Data Protection Policy

Personal data provided by the User through the Web will be treated according to the Privacy Policy available on the Web.

Users shall read and accept the Policy on Data Protection before providing their personal data to IGNIS.

8.- General aspects

Any clause or provision of this Legal Notice which may become illegible, invalid or unenforceable shall be excluded and will be considered inapplicable with respect to such illegality, invalidity or unenforceability and will be replaced by any other as similar as possible to the previous one but it shall not affect or damage the remaining provisions which shall be left aside from any illegal, invalid or unenforceable clause and shall remain therefore with full force and effect.

IGNIS excludes any kind of guarantee and therefore is released from any responsibility arising from the aspects expressed above as well as from other aspects which may not be considered in this document.

9.- Applicable legislation

The relationship between IGNIS and the User shall be governed by the current Spanish legislation.
